Trade-in program (the "Program") overview:
End Users who purchase Symbol MC9000-G mobile computers between April 1, 2004 and November 30, 2004 will be eligible for a $200 per unit trade-in rebate with the receipt of their old hand-held computer(s). The total trade-in value will be based on a 1:1 ratio of eligible units traded-in, and the number of Symbol MC9000-G units purchased (i.e.: the rebate is payable on the lesser of the following two: the number of Symbol MC9000-Gs purchased, or the number of eligible units submitted and claimed for trade-in). For the purpose of this program, "end user" shall be defined as the individual or entity that acquires or uses the products (both the MC9000-G and the trade-in units) for its own use and not for resale.

Eligibility:
The Program is available to end-users customers of Symbol products in the following countries: United States, Canada, and Puerto Rico.

Products accepted for trade-in rebate:
Only the following products are accepted for trade-in rebate at a value of $200 (US) per working unit of the products shown below. Symbol Products currently on lease by the end user also qualify.

The trade-in value will be paid in US dollars ($).

Current Service Contract Time Credit:
If your trade-in equipment is covered under a current Symbol service contract, and a service contract is purchased on the replacement equipment, Symbol will extend the term of the new contract ( once the trade-in units are received by Symbol and you have returned a signed Contract Ammendment) for a corresponding period, so that the remaining term on your current service contract will be added to your new contract.

How to apply for your trade-in rebate:

1. After you have purchased your new Symbol MC 9000-G mobile computer(s), click here to register for your rebate. Please complete all the information requested.

Notice: You MUST register for the rebate online in advance, and complete ALL information requested, otherwise your shipment of trade-in units will not be accepted.

2. Once the form is completed and submitted, you will receive a Trade-in Merchandise Authorization (TMA) via email within approximately 48 hours. This TMA will contain a unique claim number (TMA number), which you may use for acquiring claim status or making subsequent inquiries about your trade-in. If more than 48 hours from the submission of your claim have elapsed and you have not received a TMA, please email tradeup@ccionline.biz
3. Return only the products qualifying for rebate to the address provided by Symbol on your TMA. Do NOT return batteries with your shipment. Trade-in units must be in working order.
4.

Important: The following items MUST accompany the merchandise returned:

A copy of the TMA showing the TMA number

A photocopy of the original purchase invoice showing the Reseller name, purchase date, invoice number, product serial numbers and total claimed purchase quantity of Symbol MC9000-G mobile computers.


5. Shipments must be postmarked within 60 days of the MC9000-G product purchase date, and not later than January 31, 2005.
6. Status of your claim may be checked on this site. Simply see Trade-in overview on the top level navigation, and go to the "My Claim Activity" drop down and enter your TMA number, or Click here.

Trade-in remittance:
• The trade-in value will be remitted via check to be issued and mailed, payable to the company name provided on the online TMA application.

• Allow 6-8 weeks after postmarked date of your trade-in shipment for receipt of payment.

Check list for Trade-in Shipments
Please verify your compliance with the following for prompt handling of your claim:
1.

Applying for, and receiving a confirmed TMA prior to shipping the trade-in units.  

2. Including a copy of the TMA and the Reseller invoice with your shipment.
3. Assuring that the Reseller invoice submitted correctly represents the quantity of Symbol MC9000-Gs purchased and claimed.
4.

Submitting the correct model number and quantity of trade-in units as indicated on the TMA.

5. Providing complete and accurate information for your remittance.

Failure to do any one of these can delay or disqualify your claim

Credit on existing Service Contracts
1.

Symbol will automatically remove returned units from current Symbol contracts effective date of receipt by Symbol.  

2. Credit on any remaining prepaid balance will be applied to the contract holder's SAP account, within 60 days of receipt.
3. If the contract holder's SAP is inactive, and the account is in good standing, the contract holder may request cash payment from the Symbol credit department.
4.

If the contract holder is a Reseller, the end user must seek service credit from the contract holder.


How to apply for service time credit:
1.

Fill in and sign the Contract Amendment mailed to you 3 to 4 weeks after receipt of trade-in units, and mail to the Symbol partner from whom the new service contract was purchased.

2. Symbol will not begin the time credit process until a written request has been received signed by the newly purchased contract holder, which is the Symbol business partner from whom you have purchased the service contract or their distributor.
3. Symbol will revise the new contract issued for the replacement product within 60 days of receiving the applicable signed Contract amendment. A the A revised Service Order Form, containing a new contract number and reflecting the extended time period will be issued and mailed to the new contract holder.

Other program terms and conditions

This offer only applies to the purchase of Symbol MC9000-Gs between April 1, 2004 and November 30, 2004, as indicated on the purchase invoice.  

The MC9000-Gs purchased by the End User and claimed for rebate under the Program cannot be retuned.
All trade-in items returned become the property of Symbol Technologies, Inc. (Symbol)

Trade-in units must be in working order, and trade-in rebate will not be paid for non-working units received.

Trade-in rebates will only be paid on that amount approved and indicated on the TMA. Merchandise returned in excess of what was indicated on the TMA or in non-working order, will become the property of Symbol and will not be returned to the shipper.

This offer is not valid when combined with any other offer, promotion or special pricing approved by Symbol.

Handwritten invoices will not be accepted as proof of purchase. Symbol and its agents have the right to validate and verify any purchases claimed and serial numbers submitted.

Symbol reserves the right to modify, withdraw or cancel this Program (in whole or in part) at any time and/or in any geography for any reason or for no reason, without prior notice.

Symbol is not responsible for lost, stolen, or misdirected shipments, or for any units damaged in shipment.

Rebate checks are void if not cashed within 90-days of issuance, and will not be re-issued.
Any claims or trade-in shipments that do not comply with the terms of the Program will be rejected.  

This Program is subject to all local laws and regulations.

Symbol and its agents are not responsible for End Users' hardware, software or system failures of any kind, loss of data, and unavailability of network connections, which may result from a participation in the Program and complying with its rules.

End User must have title to the trade-in units at the time of shipment to Symbol, and such units should be free from any liens and encumbrances and not serve as collateral under a lease.

Limitation of liability

By participating in the program, you agree that Symbol, its affiliate and subsidiary companies, advertising and Program agencies and their respective officers, directors, employees, representatives and agents will have no liability whatsoever for any injuries, losses, or damages of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from participation in the Program or acceptance, possession, use or misuse of any rebate funds that will be provided. Symbol is not responsible for printing or typographical errors in any Program-related materials, for stolen, lost, late, misdirected, damaged, incomplete or illegible registration or for postage due mail. If, for any reason, the Program is not capable of running as planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Symbol which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, Symbol reserves the right at its sole discretion to cancel, terminate, modify or suspend the Program. Any deliberate attempt by a participant or any other individual to damage any web site or undermine the legitimate operation of the Program is a violation of criminal and civil laws and should such an attempt be made, Symbol reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Symbol, and its affiliates, subsidiaries, advertising and Program agencies, and Internet access providers are not responsible for incorrect entry of information by participant, or technical malfunctions of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, human error, lost/delayed data transmission; or transactions that are processed late or incorrectly or are lost due to computer or electronic malfunction.

Disputes

THIS PROGRAM IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF NEW YORK, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.   As a condition of participating in this Program, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Program, shall be resolved individually and participant hereby irrevocably submits for itself and its property in any legal proceedings relating to the Program and enforcement of any judgments with respect and in connection thereto, to the exclusive general jurisdiction of the courts of the State of New York, in the County of Suffolk, New York, and to the United States District Court for the Eastern District of New York, and to the respective appellate courts thereof in connection with any appeal therefrom. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, consequential or other damages, including attorneys' fees, other than the fair market value of the trade-in units shipped by participant, and participant further waives all rights to have damages multiplied or increased and to trial by jury.

Under no circumstance will Symbol be liable for any participant's incidental, consequential, special, punitive, or exemplary damages of any kind, including lost profits, loss of business, or other economic damage arising out of or resulting from Symbol's offering, conducting and/or terminating the Program or for any amount in excess of the market value of a participant traded-in units.

Where Symbol is required by law to provide the Program Official Rules in the local language or where the participant requires that the Program Official Rules will be provided in a local language, the participant acknowledges that in the event of any dispute arising out of or in connection with the Program, including any question regarding its existence, validity or termination, that the English language version shall apply and the local language version shall not apply.
